This Auction Policy & Agreement (“Policy”) governs all auction-related activities on Hustlefella.com (“Platform”, “Marketplace”, “we”, “us”, “our”). It applies to:

• Auctioneers/Vendors listing items for auction
• Bidders/Buyers placing bids
• Anyone using our auction facilities, both within South Africa and internationally

By participating in auctions, you agree to this Policy, along with our Terms & Conditions, Vendor Policy, Buyer Policy, and Privacy Policy.

1. AUCTION FACILITY OVERVIEW

Hustlefella.com provides an online auction platform:

• Vendors may list physical or digital products for timed auctions
• Bidders place competitive bids until auction closure
• Automatic bid increments, Buy Now, and reserve prices are supported
• Hustlefella acts solely as an intermediary platform, not as seller of record

2. ELIGIBILITY

2.1 Vendors / Auctioneers

• Must comply with Hustlefella’s Vendor Policy
• Must legally own or be authorized to sell auctioned items
• Must be 18+ and legally permitted to conduct sales in their jurisdiction

2.2 Bidders / Buyers

• Must comply with Hustlefella’s Buyer Policy
• Must be 18+ and capable of fulfilling payment obligations
• Restricted individuals (sanctioned, banned, or fraudulent) are not permitted

3. AUCTION LISTING RULES (VENDORS)

• Items must be legal, authentic, and accurately described
• High-quality images and accurate specifications are required
• Reserve prices may be set to protect minimum selling price
• Buy Now may be enabled to end the auction immediately if used
• Auction start and end times are binding; Hustlefella may extend for last-minute bids to prevent “sniping”
• Vendors must disclose defects, damage, or limitations

Prohibited Auction Items Include:

• Illegal, counterfeit, or banned items
• Weapons, explosives, narcotics
• Adult content, stolen goods, or unauthorized IP items
• Hazardous materials without proper licensing

4. BIDDING RULES (BIDDERS)

• All bids are binding and final
• Bids cannot be retracted except for clear system errors
• Minimum bid increments must be followed
• Auto-bidding tools may be used if supported but Hustlefella is not responsible for errors
• Winning bidders must pay the full auction amount plus shipping and applicable taxes within the specified timeframe

5. PAYMENT TERMS

Payments are to be processed via approved gateways only (Yoco, PayFast, Stripe, PayPal).

Failure to pay may result in:

• Auction cancellation or awarding to next-highest bidder
• Account suspension
• Debt collection or legal action

Hustlefella commissions and payment gateway fees apply.

Buyers are responsible for customs, duties, and taxes for international orders.

6. SHIPPING & DELIVERY

Vendor Responsibilities

• Ship items promptly after payment confirmation
• Provide tracking information
• Ensure compliance with domestic and international shipping regulations

Buyer Responsibilities

• Provide accurate shipping information
• Pay customs, duties, or import taxes as required
• Accept delivery risks outside Hustlefella’s control

Non-Delivery

• Vendors must fulfill winning bids
• Failure may result in refunds, penalties, or legal action

7. RETURNS, REFUNDS & CANCELLATIONS

Physical Items

Refunds only for:

• Non-delivery
• Damaged or misrepresented items
•  

Digital Items

• Refunds for non-delivery or non-functioning digital items

Services

• Refunds if service is not provided as described

Dispute Resolution

• Buyers and vendors must attempt resolution first
• Hustlefella may mediate disputes; final decisions are binding
• Multiple non-compliance cases may lead to account suspension or banning

8. INTELLECTUAL PROPERTY & PROHIBITED ACTIVITIES

• Vendors must have rights to auctioned items
• Selling infringing IP items is prohibited
• Buyers and vendors may not attempt fraudulent transactions, manipulative bids, or circumvent platform rules
• Violations may result in permanent bans and legal action

9. ACCOUNT SUSPENSION & TERMINATION

Hustlefella may suspend or terminate accounts for:

• Fraudulent bids or auctions
• Non-payment of winning bids
• Misrepresentation of auction items
• Multiple unresolved disputes or complaints
• Breach of Vendor, Buyer, or Auction Policy

Penalties may include:

• Auction cancellation
• Forfeiture of funds or fees
• Permanent account ban

10. INTERNATIONAL AUCTIONS

• Buyers are responsible for customs clearance, duties, and import taxes
• Not all items can be legally shipped internationally
• Hustlefella is not liable for international shipping delays, confiscations, or fines

11. LIMITATION OF LIABILITY

• Hustlefella acts only as a platform
• Not responsible for item defects, misrepresentation, non-delivery, or disputes
• Platform is provided “as-is”
• Buyer and vendor remedies are limited to refunds, dispute resolution, and other platform remedies

12. POLICY UPDATES

Hustlefella may update this Auction Policy at any time. Continued participation in auctions signifies acceptance of any updates.

13. ACCEPTANCE

By participating in auctions, you acknowledge:

• You have read and understood this Policy
• You agree to all auction rules, vendor and buyer responsibilities
• All bids and transactions are legally binding
