1. Introduction
Welcome to Hustlefella Auctions. By registering, listing, bidding, or purchasing on the platform, you agree to these Auction Terms & Conditions.
Hustlefella operates as an online auction platform connecting buyers and sellers and may act as an intermediary in transactions but does not own listed items unless explicitly stated.
2. Eligibility & Registration
- Users must be 18 years or older and legally capable of entering binding contracts.
- All bidders and sellers must:
- Register an account
- Provide accurate personal and contact information
- Pass verification (KYC where applicable)
- Hustlefella reserves the right to approve, reject, or suspend accounts.
3. Auction Structure
- Auctions may be:
- Timed (fixed closing time)
- Live (real-time bidding)
- Each listing (“Lot”) is treated as a separate transaction.
- Auctions may be:
- With reserve price
- Without reserve (highest bid wins)
4. Bidding Rules
- All bids:
- Are legally binding offers to purchase
- Cannot be withdrawn once placed (unless allowed by law or system rules)
- The highest valid bid at closing wins, subject to:
- Reserve price
- Seller confirmation (if applicable)
- Hustlefella may:
- Reject suspicious or fraudulent bids
- Extend auctions if bids occur near closing time (anti-sniping)
5. Anti-Fraud & Fair Bidding
- No:
- Fake bidding (“ghost bidding”)
- Seller self-bidding
- Collusion between bidders
- Violations may result in:
- Immediate account suspension
- Legal action
- Auctions comply with the Consumer Protection Act (CPA) Section 45 principles.
6. Seller Responsibilities
Sellers must:
- Provide accurate descriptions, images, and disclosures
- Confirm legal ownership of items
- Disclose defects or conditions
- Honour winning bids
Hustlefella is not responsible for incorrect listings, which remain the seller’s responsibility.
7. Buyer Responsibilities
Buyers must:
- Review listings carefully
- Ask questions before bidding
- Pay within the specified timeframe
Failure to pay may result in:
- Account suspension
- Loss of deposit
- Legal recovery action
8. Escrow Service
To ensure secure transactions, Hustlefella provides an “Escrow” Service:
8.1 How Escrow Works
- Buyer wins auction
- Buyer pays funds into Hustlefella escrow account
- Seller ships/delivers item
- Buyer confirms receipt
- Funds released to seller
8.2 Protection Rules
- Funds are held securely until delivery is confirmed
- If disputes arise:
- Funds are frozen
- Investigation is conducted
- Hustlefella may:
- Refund buyer
- Release funds to seller
- Split settlement where appropriate
9. Payments & Fees
- Winning bidders must pay:
- Hammer price (winning bid)
- Buyer’s premium (if applicable)
- VAT (if applicable)
- Payment deadline: typically 24–48 hours after invoice
- Accepted payment methods:
- EFT
- Card payments
- Approved gateways
10. Delivery & Collection
- Sellers must ship within stated timelines
- Buyers must collect/accept delivery promptly
- Risk transfers:
- Upon delivery confirmation OR
- As defined in listing
11. Condition of Goods (Voetstoots)
- All items are sold “as-is” (voetstoots) unless stated otherwise
- No guarantees or warranties unless explicitly provided
- Buyers are responsible for due diligence
12. Returns, Refunds & Disputes
- No returns unless:
- Item materially differs from description
- Fraud or misrepresentation occurs
- Disputes:
- Must be submitted within a defined timeframe (e.g. 48 hours)
- Will be mediated by Hustlefella
- Escrow ensures fair resolution
13. Auction Completion
- A sale is complete when:
- Auction closes and highest bid is accepted
- The winning bid forms a binding contract between buyer and seller
14. Platform Rights
Hustlefella reserves the right to:
- Cancel auctions
- Remove listings
- Suspend users
- Reverse transactions in case of:
- Fraud
- System error
- Legal non-compliance
15. Limitation of Liability
Hustlefella:
- Is a facilitator, not the seller
- Is not liable for:
- Listing inaccuracies
- Failed transactions outside escrow protection
- Technical failures or missed bids
16. Amendments
- Terms may be updated at any time
- Continued use of the platform = acceptance of updated terms
17. Governing Law
These terms are governed by the laws of South Africa, including:
- Consumer Protection Act (CPA)
- Electronic Communications & Transactions Act
