Vendor Terms

This Vendor Policy (“Policy”) governs all individuals and businesses (“Vendors”) who register, list products or services, and conduct sales on Hustlefella.com (“Platform”, “Marketplace”, “we”, “us”, “our”), a website based in South Africa.

By creating a vendor account, using the vendor tools, listing products/services, or making sales on the Platform, you agree to this Vendor Policy, the Terms & Conditions, Privacy Policy, and any supplemental rules published by Hustlefella.com.

1. VENDOR ELIGIBILITY

To sell on Hustlefella.com, a Vendor must:

  1. Be at least 18 years old.

  2. Have a valid South African ID, passport, or legally acceptable identification if international.

  3. If a business entity, be duly registered and compliant in their jurisdiction (e.g., CIPC, tax registration, etc.).

  4. Provide accurate contact details and maintain an active phone number and email.

  5. Maintain a valid bank account for payouts.

  6. Not be restricted or banned by applicable laws, sanctions, or trade regulations.

2. PRODUCT & SERVICE LISTING RULES

Vendors may list physical goods, digital goods, or services, provided that:

2.1 Prohibited Items (Global)

The following items are strictly prohibited:

  • Illegal products under South African or international law
  • Weapons, explosives, ammunition
  • Drugs, narcotics, illegal substances
  • Counterfeit or trademark-infringing goods
  • Pornography, adult content, or explicit services
  • Stolen goods, hacked accounts, or illegal access devices
  • Hazardous chemicals without proper licensing
  • Wildlife products banned under CITES
  • Human remains or body parts
  • Any item violating intellectual property laws

2.2 Restricted Items (Require Approval or Licensing)

  • Alcohol
  • Tobacco products
  • Pharmaceuticals
  • Medical services/equipment
  • Financial services
  • Industrial chemicals
  • Food items (must meet health regulation standards)
  • Vendor must upload any required certifications or approvals.

2.3 Accuracy of Listings

Vendors must ensure:

  • Listings are accurate, complete, and truthful.
  • Photos are of the actual product (no unauthorized stock photos).
  • Pricing includes all required taxes and regulatory costs.
  • Shipping fees are clearly visible to the buyer.
  • Service listings specify scope, availability, and any limitations.

3. VENDOR CONDUCT

Vendors agree to:

  1. Act professionally and respectfully toward all buyers.

  2. Abide by South African laws and international trade laws.

  3. Not attempt to bypass Hustlefella.com or redirect customers off-platform.

  4. Not manipulate reviews, ratings, or platform systems.

  5. Not spam or harass buyers.

  6. Not engage in fraudulent, deceptive, or misleading behaviour.

4. PRICING & TAX COMPLIANCE

4.1 Vendor Responsibility

Vendors are fully responsible for:

  • Setting their own prices
  • Complying with VAT or sales tax laws in their country
  • Reporting income to applicable tax authorities

Hustlefella.com does not collect or remit VAT on behalf of vendors unless required by law in the future.

4.2 Displayed Price

Prices must always include:

  • VAT (if applicable)
  • Mandatory fees
  • Accurate shipping costs

5. PAYMENT, FEES & COMMISSIONS

5.1 Commission Fees

Hustlefella.com may charge a commission per sale as published on the Pricing Structure. This fee may vary by category.

5.2 Payout Schedule

  • Payouts occur to the Vendor’s registered bank account after the buyer’s payment is confirmed and any dispute window has closed.
  • Hustlefella.com may hold funds for investigation in case of fraud, chargebacks, or disputes.

5.3 Transaction Fees

Payment gateways (e.g., Yoco, PayFast, Stripe, PayPal) charge additional fees. These fees are the Vendor’s responsibility unless stated otherwise.

6. SHIPPING, FULFILMENT & DELIVERY

6.1 Vendor Responsibility

The Vendor is entirely responsible for:

  • Packaging
  • Shipping
  • Delivery times
  • Tracking numbers
  • Logistic partners
  • Cross-border compliance (for international vendors or buyers)

6.2 Delivery Time Requirements

Vendors must:

  • Ship items within the time frame provided in the listing
  • Communicate delays immediately to buyers
  • Provide tracking where applicable
  • Ensure safe packaging and handling

6.3 Non-Delivery

If a vendor fails to ship or deliver an item:

  • The buyer will be refunded
  • Hustlefella may deduct the refund from vendor earnings
  • Vendor may face suspension or permanent ban

7. RETURNS, REFUNDS & DISPUTES

7.1 Vendor Must Honor Policies

Vendors must follow Hustlefella.com’s Refund & Return Policy, which includes:

  • Defective or damaged items
  • Incorrect items
  • Non-delivery
  • Misrepresentation
  • Service not rendered

7.2 Vendor Response Time

Vendors must respond to disputes or refund requests within 48 hours.

7.3 Resolution Hierarchy

If a dispute arises:

  1. Vendor and buyer attempt to resolve via messaging

  2. If unresolved, Hustlefella.com mediates

  3. Hustlefella.com’s decision is final

Failure to cooperate may result in penalties, payout holds, or account suspension.

8. INTELLECTUAL PROPERTY (IP) RULES

Vendors must:

  • Own the rights to all photos, content, and products listed
  • Not infringe third-party copyrights, trademarks, or patents
  • Immediately remove listings if an IP violation notice is received

Repeat offenders may be permanently banned.

9. DATA PROTECTION & PRIVACY

Vendors may not:

  • Collect buyers’ personal data outside the platform
  • Use customer information for any purpose other than fulfilling the order
  • Add customers to external email lists without explicit consent

Hustlefella.com:

  • Protects personal data under POPIA (South Africa) and global privacy standards
  • Reserves the right to audit vendor data handling practices

10. ACCOUNT SUSPENSION, TERMINATION & PENALTIES

Hustlefella.com may suspend or terminate a Vendor account for:

  • Violating this policy
  • Fraudulent activity
  • Repeated customer complaints
  • Selling illegal or harmful items
  • Chargeback abuse
  • Non-compliance with laws
  • Attempting to bypass fees
  • Abusive behaviour

Penalties may include:

  • Withholding payments
  • Removal of listings
  • Permanent platform ban
  • Legal action (if required)

11. INTERNATIONAL VENDORS

Vendors outside South Africa are responsible for:

  • Customs documentation
  • Import/export compliance
  • International taxes
  • Laws of their origin country and destination country
  • Currency fluctuations

Hustlefella.com is not responsible for cross-border regulatory compliance.

12. LIMITATION OF LIABILITY

Hustlefella.com:

  • Acts only as an intermediary marketplace
  • Is not the seller of record
  • Does not manufacture, store, or ship vendor products
  • Is not liable for vendor misconduct, damages, or financial loss
  • May assist with dispute resolution but is not obligated to compensate buyers or vendors beyond the transaction amount

13. POLICY UPDATES

Hustlefella.com may update this Vendor Policy at any time. Continued use of the platform constitutes acceptance of the updated terms.

14. ACCEPTANCE

By registering as a Vendor, you acknowledge that you have read, understood, and agree to comply with this Vendor Policy in full.
