Hire Talent Policy

This Talent Pool & Hire Talent Policy (“Policy”) governs the use of Hustlefella’s Talent Pool / Hire Talent service (the “Service”) available on Hustlefella.com (“Hustlefella”, “the Platform”, “we”, “us”). This Policy applies to all individuals registering as talent, all visitors or users seeking to hire talent, and all interactions arising from the Service.
This Policy must be read together with Hustlefella’s Terms & Conditions, Community Guidelines, Refunds & Returns Policy, and Dispute Resolution Policy. In the event of conflict, the hierarchy defined in those documents applies.
1. Purpose & Nature of the Talent Pool
1.1 The Talent Pool is a directory and discovery service designed to:
- Help skilled individuals, tradespeople, freelancers, and job-seekers showcase their skills
- Enable registered Hustlefella users to identify and contact such individuals
1.2 Hustlefella is not:
- An employer
- A recruitment agency
- A labour broker
- An employment agency under South African law
1.3 Hustlefella does not:
- Place workers
- Negotiate employment terms
- Supervise work
- Guarantee skill, performance, availability, or conduct
All engagements occur directly between the hiring party and the talent.
2. Access & Registration Requirements
2.1 Talent Registration
Individuals registering as talent must:
- Be legally eligible to work in their jurisdiction
- Provide accurate, truthful, and current information
- Consent to identity, credential, or background checks where applicable
- Keep profile information up to date
False or misleading information may result in immediate removal.
2.2 Hirer / Employer Access
Access to contact talent profiles is restricted to registered Hustlefella users. Hustlefella may impose additional verification or access controls at its discretion.
3. Verifiable Information & Reports
3.1 Hustlefella may collect and display verifiable information, including but not limited to:
- Identity verification
- Skill confirmations
- Business registration or trade references
- Publicly available records
3.2 Any verification or report:
- Is conducted on a best-effort basis only
- May be limited, partial, outdated, or incomplete
- Does not constitute certification, endorsement, clearance, or recommendation
3.3 Published reports are informational only and must not be relied upon as sole due diligence.
4. No Endorsement, No Warranty
4.1 Hustlefella does not endorse, recommend, or guarantee any talent.
4.2 All talent is engaged at the hirer’s own risk.
4.3 Hustlefella disclaims all warranties, express or implied, including:
- Fitness for purpose
- Skill level
- Legal compliance
- Safety or suitability
5. Due Diligence Responsibility
5.1 Hirers are solely responsible for:
- Interviewing and vetting talent
- Verifying qualifications, references, and licences
- Assessing suitability and safety
- Complying with labour, tax, immigration, and regulatory laws
5.2 Talent is solely responsible for:
- Representing skills accurately
- Maintaining legal right to work
- Compliance with licensing and trade regulations
6. Employment Relationship Disclaimer
6.1 Use of the Talent Pool does not create:
- An employment relationship with Hustlefella
- An agency, partnership, or joint venture
6.2 Hustlefella bears no responsibility for:
- Wages, fees, or benefits
- UIF, PAYE, VAT, or tax obligations
- Workplace injuries or occupational safety
7. Independent Contractor vs Employee
7.1 Determination of employment status rests solely with the engaging parties and applicable law.
7.2 Hustlefella does not classify or enforce worker status.
8. Payments & Contracts
8.1 Hustlefella does not set rates or terms unless explicitly stated.
8.2 Written agreements between hirer and talent are strongly recommended.
8.3 Payments made outside Hustlefella are entirely at user risk unless platform tools are used.
9. Conduct & Professional Standards
9.1 Talent Obligations
Talent must:
- Act professionally and lawfully
- Respect safety, confidentiality, and property
- Avoid misrepresentation or fraudulent conduct
9.2 Hirer Obligations
Hirers must:
- Provide safe working conditions
- Avoid exploitation or unlawful practices
- Respect agreed terms
10. Prohibited Use
The Talent Pool may not be used for:
- Illegal or unsafe work
- Human trafficking, forced labour, or exploitation
- Discrimination or harassment
- Circumventing Hustlefella safeguards
11. Safety & Risk Allocation
11.1 Hustlefella is not responsible for:
- Personal injury
- Property damage
- Theft or loss
- Workplace incidents
11.2 Users assume all risks associated with in-person engagements.
12. Disputes
Disputes arising from Talent Pool engagements are between the parties and governed by the Dispute Resolution Policy where applicable.
13. Removal, Suspension & Monitoring
Hustlefella may:
- Remove profiles
- Suspend access
- Terminate accounts
Where policy violations, safety concerns, or legal risks arise.
14. Data Protection & Privacy
14.1 Personal information is processed in accordance with:
- South African POPIA
- Applicable international data protection laws
14.2 Users consent to reasonable processing and display of profile data.
15. Limitation of Liability & Indemnity
15.1 Hustlefella’s liability is limited to the maximum extent permitted by law.
15.2 Users agree to indemnify Hustlefella against claims arising from:
- Engagements
- Misrepresentation
- Legal non-compliance
16. International Use
Users engaging across borders are responsible for:
- Immigration and work authorisation
- Tax compliance
- Local labour laws
17. South African Labour-Law Safe Harbour
17.1 Hustlefella provides the Talent Pool strictly as an information and introduction service.
17.2 Nothing in the operation of the Talent Pool is intended to, or shall be interpreted to:
- Create an employment relationship as contemplated in the Labour Relations Act (LRA)
- Establish employer obligations under the Basic Conditions of Employment Act (BCEA)
- Trigger registration, contribution, or reporting obligations under the Unemployment Insurance Act (UIF)
17.3 Hustlefella does not:
- Control working hours, methods, or supervision
- Provide tools, equipment, or uniforms
- Pay remuneration or benefits
- Discipline or dismiss workers
17.4 Any presumption of employment under South African law must be assessed solely between the hirer and the talent, based on the factual working relationship.
17.5 Users expressly acknowledge that Hustlefella operates within a safe harbour framework as a digital platform and shall not be deemed a co-employer, labour broker, or temporary employment service.
18. Codes of Conduct
18.1 Talent Code of Conduct
Talent registered on Hustlefella must:
- Provide truthful and accurate profile information
- Maintain valid licences, permits, and right-to-work status
- Perform work safely, competently, and lawfully
- Respect hirer property, confidentiality, and personal boundaries
- Refrain from harassment, intimidation, or unlawful conduct
- Immediately report safety incidents or illegal requests
Violation may result in suspension or permanent removal.
18.2 Hirer Code of Conduct
Hirers using the Talent Pool must:
- Provide lawful, safe, and non-discriminatory working conditions
- Clearly communicate scope, expectations, and compensation
- Comply with applicable labour, tax, and safety laws
- Avoid exploitation, coercion, or misclassification
- Respect talent dignity, safety, and agreed terms
Violation may result in access restriction or account termination.
19. Incident & Safety Reporting (Off-Platform Work)
19.1 Hustlefella is not responsible for on-site safety or supervision.
19.2 Users are encouraged to report serious incidents, including:
- Physical injury or harm
- Threats, violence, or harassment
- Unsafe or illegal work requests
- Suspected exploitation or trafficking
19.3 Reports may be used to:
- Assess platform risk
- Suspend or remove users
- Cooperate with lawful authorities where required
19.4 Hustlefella does not investigate incidents as an employer or regulator and does not guarantee outcomes.
20. Talent Profile Disclaimer (UI Notice)

Talent profiles, verifications, and reports on Hustlefella are provided for informational purposes only. Hustlefella does not endorse, employ, certify, or guarantee any individual listed. All hiring decisions, background checks, and legal compliance remain the sole responsibility of the hiring party.
21. Policy Amendments
Hustlefella may amend this Policy at any time. Continued use constitutes acceptance.
22. Contact & Support
All Talent Pool-related queries must be submitted through Hustlefella support channels.
By using the Hustlefella Talent Pool / Hire Talent service, all users acknowledge and agree to this Policy.
